For a long time, the right to health care has been treated as a secondary right that does not require any mechanisms for its implementation in national legislation. This has led to withering interest in this right and a lack of investment in its realization.

However, the situation is undergoing significant change as countries increasingly incorporate health and other rights-based enforcement mechanisms into their constitutions and national laws as fundamental and guaranteed rights. The judiciary, particularly in Asia, Africa, and Latin America, has made significant contributions to the domestic implementation of the right to health and the development of health law through landmark decisions in this area.

Despite positive developments in ensuring the highest attainable standard of physical and mental health, the right to health is not fully realized for everyone, and the highest attainable standard of health remains out of reach for most marginalized and most vulnerable populations. Many face discrimination, violations of their basic rights, and abuse by health care providers when they go to health care facilities. As noted in my report to the UN General Assembly on informed consent and the right to health care, the rights to privacy and bodily integrity are violated in many facilities. Patients and physicians alike need support in preventing, detecting, and redressing harm in cases of human rights violations in health care settings.

Most often, this is the case when the inherent inequality of the doctor-patient relationship, caused by the patient’s need to trust the doctor and the difference in their level of knowledge and experience, is exacerbated by a certain vulnerability of the patient due to their class, gender, ethnicity and other socio-economic factors.
